‘Supreme Court Will Hand Immunity Case Back to Judge Chutkan’ MAGA Hit With New Prediction
The Supreme Court is anticipated to return the high-profile case regarding Donald Trump’s bid for absolute criminal immunity to U.S. District Court Judge Tanya Chutkan, potentially favoring special counsel Jack Smith, according to legal experts.
In a discussion on MSNBC’s “Morning Joe,” Palm Beach County State Attorney Dave Aronberg shared insights on the Supreme Court’s forthcoming decision.
He emphasized that a return of the case to Judge Chutkan’s court could significantly benefit Smith, the special counsel overseeing the investigation.
As reported by Raw Story on Thursday, June 20, 2024, Aronberg elaborated on the Supreme Court’s current position and the conservative influence that appears to be affecting the case’s progress.
He criticized the Court for seemingly delaying a straightforward ruling due to its conservative bias.
“Some believe the Supreme Court is skewing justice by stalling Trump’s accountability,” Aronberg remarked. He explained that Smith had preemptively approached the Supreme Court to expedite the process before the D.C. Circuit Court of Appeals could issue its decision.
However, the Supreme Court initially deemed it premature. Despite this, the Court later intervened post the D.C. Circuit’s comprehensive ruling, causing frustration among observers who expect the judiciary to remain impartial.
Aronberg highlighted the strategic delay that benefits Trump, aligning with MSNBC legal analyst Lisa Rubin’s perspective that Trump’s legal team could be aiming to push the trial past the upcoming election.
“This situation appears to help Trump avoid immediate trial proceedings, potentially enabling him to become president again and dismiss the case entirely,” Aronberg explained.
However, Aronberg suggested that the Supreme Court might eventually return the case to Judge Chutkan for additional fact-finding.
This process would involve determining whether Trump’s actions fall under his official duties and if immunity applies. This scenario likely means the trial would not commence before the election.
Despite the delay, Judge Chutkan appears determined to expedite the case. She has expressed her willingness to forgo her vacation to hold a public hearing, which could bring crucial evidence of Trump’s involvement in the events leading up to January 6 into public view.
Aronberg noted, “Even if Trump succeeds in delaying the trial, Smith could achieve a partial victory as significant evidence might still be unveiled during these proceedings.”
While the Supreme Court’s anticipated decision to return the case to Judge Chutkan could delay the trial, it might also pave the way for revealing substantial evidence against Trump.
This development could inadvertently serve the interests of special counsel Jack Smith and those seeking accountability for the events surrounding January 6.
