According to Newsweek on Tuesday, August 27, 2024, former U.S. Attorney Joyce Vance, a respected legal analyst, recently expressed her belief that the 11th Circuit Court of Appeals will likely overturn Judge Cannon’s decision, allowing the case against Trump to proceed.
Vance, known for her insightful commentary on legal issues, shared her thoughts in a recent post on her blog, Civil Discourse.
She examined the 58-page brief submitted by Smith on August 27, which meticulously outlined the errors in Cannon’s ruling.
Smith, who was appointed as special counsel to oversee the federal investigations into Trump, argued that Cannon’s decision was based on a fundamental misunderstanding of constitutional principles, particularly concerning the separation of powers and the appointment of special counsel.
In her 93-page opinion, Judge Cannon argued that Smith’s appointment, along with the funding for his office, violated the Constitution.
